TARDE SCOTUS Rules IEEPA Tariff Illegal

Fri, February 20, 2026 10:45 AM | Mariane Rowden (Administrator)

Washington, DC --

Today, the U.S. Supreme Court issued its long-awaited decision in the "IEEPA Tariff Case" where Plaintiffs challenged the President's authority to impose tariff using the International Economic Emergency Powers Act (IEEPA), which has been traditional used for foreign affairs.  The Supreme Court held that the President does NOT have the authority under IEEPA to impose tariffs. See Learning Resources, Inc. v. Trump, President of the United States.

Any company that paid IEEPA tariffs over the last year should file a lawsuit to claim a refund of the tariffs.  Please contact EMTC (mrowden@emtc.org) for more information.
