TRADE INFORM Act provides seller information

Tue, February 28, 2023 9:22 AM | Karen Kelly (Administrator)

Starting on June 27, 2023, eBay will disclose the name (or company name) and physical address of sellers because the INFORM Act, part of the Omnibus passed in December 2022 requires it. eBay has been collecting and verifying identification and contact information for several months in preparation for this law. Non-compliance with this Act subjects the seller to civil penalties under the Federal Trade Commission (FTC).

The purpose of the bill, Integrity, Notification, and Fairness in Online Retail Marketplaces for Consumers (INFORM Consumers) Act, is to combat the online sale of stolen, counterfeit, and dangerous consumer products . The Act applies to "high volume sellers"  eBay will collect personal data if you sell 200+ items totaling $5k in annual sales.  Sellers who reach $20,000 annually will have their name and full address shown. Residence offices will show only state and country.  Data includes bank account, tax ID, phone and email addresses as well as name and physical address.  See Sen Durbin's press release below.

If you will be impacted by this legislation contact EMTC and let us know your thoughts.  EMTC is the trade association for small and mid sized businesses in ecommerce. Use the form on our home page or email us
